General Terms and Conditions “In Corde Meo”

Article 1. Definitions and applicability


  • In these General Terms and Conditions, the following definitions shall apply:
    • The Contractor is ”In Corde Meo”.
    • The Client is the (legal) person who subscribes to the services of “In Corde Meo” via the website of “In Corde Meo”.
    • Website: the website of “In Corde Meo” on which the Client subscribes to the services and/or takes out the subscription.
    • Services: the services offered by “In Corde Meo” on its website.
    • Subscription: the agreement to provide the services of “In Corde Meo”.
    • Administrator: the client who has taken out a subscription and/or the person(s) whom the client has appointed as administrator.
  • Applicability of these General Terms and Conditions:
    • These General Terms and Conditions apply to every offer and every agreement between “In Corde Meo” and the client, insofar as these General Terms and Conditions have not been expressly deviated from by the parties in writing.
    • These General Terms and Conditions also apply to all agreements with “In Corde Meo” for which third parties need to be involved.

Article 2. Creation of a subscription

  • All offers made by “In Corde Meo” are without obligation.
  • A Subscription comes into effect when “In Corde Meo” confirms the Subscription electronically or starts carrying out the Subscription.
  • “In Corde Meo” is entitled, if necessary without giving reasons, to refuse an application for a Subscription or to attach additional conditions to the conclusion of the Subscription.
  • The prices in the mentioned quotes are indicated both excluding and including VAT. Price changes and incorrectly stated prices are always reserved.

Article 3. Payment

  • The Contractor shall pay the Subscription Fee monthly or annually over the agreed Payment Period.
  • “In Corde Meo” reserves the right to change the Subscription Fee, inter alia on the basis of the annual inflation indexation. “In Corde Meo” will communicate a change in the Subscription Fee to the Client in advance via e-mail. The changed Subscription Fee shall apply to all current and new Subscriptions as of the next Payment Period.
  • In case of direct debit, the amount will be collected by “In Corde Meo” immediately after the advance notice of the direct debit.
  • Reversing an amount automatically collected by the Client does not release the Client from his/her payment obligation.

Article 4. Termination and renewal of the agreement

  • Upon expiry of the Subscription, the agreement shall automatically terminate, unless the Client renews the Subscription.
  • The Client may renew the Subscription in the interim and at the end of the term.
  • The Subscription shall also be terminated if the Client fails to pay the Subscription Fee.

Article 5. How the Subscription works

  • The Client takes out a Subscription with “In Corde Meo”. The Client determines the term and type of service of the Subscription.
  • The Client can only order and manage the Services and Subscriptions purchased by him/her via the website of “In Corde Meo”
  • The Client is entitled to appoint one or more administrators. The Client is responsible for providing information about this to the designated administrator(s).
  • “In Corde Meo” accepts the administrator(s) designated by the Client after a declaration of agreement from this/these administrator(s).
  • The Client provides the content for the purposes of the Services and the Subscription to “In Corde Meo”.
  • The Contractor “In Corde Meo” is in no way responsible for the content of the Services and/or Subscription.
  • At the end of the Subscription Period specified by the Client, “In Corde Meo” shall ensure the performance of the Services entered into by the Client.
  • If it is not possible for “In Corde Meo” to perform these Services, “In Corde Meo” will deal with the Services and Subscriptions described on the website in the manner indicated by it.

Article 6. Guarantees

  • “In Corde Meo” guarantees the performance of the Services and Subscriptions ordered by the client during the total term of the Subscriptions. “In Corde Meo” shall ensure the performance of the Services and Subscriptions according to the state of the art at the time and, if necessary, upgrade to the latest state of the art.
  • “In Corde Meo” shall ensure adequate storage of the Services and Subscriptions ordered by the Client, including adequate backup.
  • The website and the content provided by the Client are only accessible via login to the website of “In Corde Meo”. In no way will the website content be accessible via social media in any form.

Article 7. Confidentiality

  • “In Corde Meo” is obliged to keep confidential all (confidential) information it has obtained from the Client or from other sources in the context of the agreement with the Client.

Article 8. Intellectual property

  • Given the nature of the Services and Subscriptions, the Client is solely responsible for third party claims for copyright infringement of the content provided by the Client for the purposes of the Services and Subscriptions.

Article 9. (Address) details and privacy

  • The Client is obliged to provide correct (address) details when entering into the Subscription. Changes and/or inaccuracies in these details, including administrator and invoice details, must be reported to “In Corde Meo” in a timely manner.
  • Execution of the Subscription shall take place to the e-mail address(es) provided by the Client.
  • The privacy statement of “In Corde Meo” lays down how Mediahuis deals with the data of Clients and administrator(s) and how they can be inspected or objected to. The privacy statement can be found on the website of “In Corde Meo”.

Article 10. Choice of law and dispute resolution


  • The Subscription and these General Terms and Conditions are governed exclusively by Dutch law, even if an agreement is wholly or partly performed abroad or if the other party involved in the agreement is domiciled there.
  • The court in the place of business of “In Corde Meo” has exclusive jurisdiction to take cognisance of disputes, unless the cantonal court has jurisdiction. Nevertheless, “In Corde Meo” is entitled to submit the dispute to the court that has jurisdiction according to the law.
  • The parties will only appeal to the court after they have made every effort to settle a dispute by mutual agreement.
